On December 3, 2011, Dr. Franck Belibi's car was involved in a tragic accident during very extreme weather/snow conditions with multiple other cars resulting in the death of a pedestrian.
While the diagram shown above is a reconstitution of what most likely occurred after an analysis by experts, we had to reach the conclusion that the positioning of the victim in the middle of the street, the involvement of many other cars who got into contact with the pedestrian and the overwhelming evidence of another car/driver who dragged the victim away from the scene of the accident without realizing what was happening has made it difficult to determine which impact on the victim caused the death.
Dr. Franck Belibi on that night felt an impact on his car but was unaware of what was occurring due to not only the weather conditions, decreased visibility and the basic fact that a pedestrian is not normally expected to be in the middle of a busy and dark street at night away from the crosswalk.
While Dr. Franck Belibi could not possibly imagine the tragic scenario that was taking place after he felt an impact on his car, he nevertheless immediately turned back to analyze the area of the road where he felt an impact on his car but could not identify any disruption in the traffic and left the scene; he did not realize at the time that other drivers before and after him were involved in the same accident with a pedestrian.
The charges of hit and run have been dismissed from Dr. Franck Belibi's case and while this does not affect his ability to practice as a medical doctor, the Medical Board reviewed and closed the case.
